Jury Nullification, Individual Liberty, and the Power of Citizens to Resist Unjust Laws

Truth, Liberty, and the Question of Government Power

In this episode of The Global Freedom Report, host Brent Johnson introduces a program centered on truth, justice, liberty, personal privacy, and resistance to government control. He frames freedom as the birthright of Americans and other free people, asking whether individuals govern their own lives or live subject to bureaucratic permission. Brent previews a discussion of jury nullification, along with the recurring segments Lessons in Liberty and Propaganda 101. He also poses a listener question about what immediate effect confirmed extraterrestrial visitation might have on the world.

Privacy, Succession, and Freedom Bound Entities

Before the main interview, a caller named Freeman from Alaska asks Brent about succession planning involving a Panamanian Private Interest Foundation and an International Business Corporation. Brent describes these structures as tools intended to provide privacy, asset control, and international business flexibility, while explaining the roles of a foundation’s protector, beneficiaries, successor protector, and related corporation. He tells the caller that a foundation may hold passive income while an International Business Corporation may conduct profit-making activity, and he recommends a private consultation for advice tailored to the caller’s proposed structure.

Robert Anthony Peters and Jury Nullification

Brent then welcomes Robert Anthony Peters, an actor, filmmaker, policy advisor, and chairman of the Fully Informed Jury Association, also referred to as FIJA. The central discussion focuses on jury nullification, which Peters describes as a conscientious acquittal: a situation where jurors may believe the facts support a guilty finding, but also believe that conviction would produce injustice because the law itself is unjust or is being unjustly applied. Brent and Peters present juries as an important safeguard against government abuse and argue that citizens should understand the authority they possess when serving on a jury.

Historical Examples and the Modern Jury System

Peters discusses historical examples of jury nullification, including the trial of William Penn in England and the colonial trial of publisher John Peter Zenger, whose jury acquitted him after he published criticism of government officials. He also references later examples involving the Fugitive Slave Act and Prohibition, when jurors sometimes refused to convict people accused under laws they regarded as unjust. In discussing the modern system, Peters says jury nullification still exists, but argues that judges, prosecutors, jury-selection procedures, and a lack of public awareness make it difficult for jurors to exercise independent judgment.

Callers, Jury Service, and Conscience in Deliberations

Several callers join the discussion. Gregory from Los Angeles reflects on his parents’ World War II sacrifices and expresses concern about the direction of the country. Eric from Los Angeles answers the extraterrestrial question by offering his personal theory, then asks about the distinction between “trial by jury” and “jury trial,” along with the loss of jury protections in traffic cases. Brent and Peters continue discussing jury selection, plea bargaining, administrative courts, and what jurors should do when they believe a law is unjust. Peters emphasizes that jurors must be willing to stand by conscience even when facing pressure from fellow jurors or court officials.

Propaganda 101 and the Closing Call to Defend Liberty

The closing portion returns to Brent’s broader message about government, propaganda, and personal freedom. In the Propaganda 101 segment, he argues that listeners should question government messaging and resist what he views as efforts to manipulate public behavior and undermine liberty. He encourages listeners to ask what they are willing to do to preserve their freedom, whether they told the truth, kept their word, and honored their agreements. Brent closes by promoting Freedom Bound International resources, previewing a future discussion with Alan Gottlieb of the Second Amendment Foundation, and reminding listeners that he regards freedom as a gift from God that must be protected.

Our question for this week, you may have heard about all of this kind of stuff showing up
in the news. Well, if it was revealed that we really have been visited by extraterrestrials,
what immediate effects do you believe that would have on our world?
And we have an early caller. We take the caller because once we get into the interview and
everything, the callers will have to wait a little while. So let's go to Freeman, calling in from
Alaska. Freeman, welcome to the show. You are on the air.
Hello Brent. Thank you for allowing me to participate on the call.
I had a question about preparing for successors after I'm no longer around. I'm very interested in
working with you to establish a Panama Foundation and IBC. I'm wondering, are you going to be working
with the law firm to represent the foundations and IBC? Or could you give me a little bit more
clarification of what to plan for? Okay, sure. Well, first off, the Panamanian Private Interest
Foundation and International Business Corporation are designed to provide you with a way to do almost
anything between the two entities anywhere in the world and do it as anonymously as possible.
You have absolute control and nobody knows it unless you told them because Panamanian law
does not require your name to be in the public record. Now, having said that, okay, when a
foundation is created, there is a foundation council. Now, you have the power to change the
members of that council if you wish. But those people are in Panama. They know Panamanian law
and they are part of a law firm. So generally speaking, unless you have a compelling reason to
change them, my recommendation is you keep them. When you get the foundation and the International
Business Corporation, I will schedule a time to go over all the documents with you. And during
that discussion, I will ask you about successorship because I will have an electronic version of your
bylaws. And once you give me the information about who you want as your successors, I will
then complete your bylaws, send them to you for approval. You will sign them. They'll get sent
down to Panama and the deed will be done. So that is how that is how your successorship
is addressed. Now, you have a couple of things you should be aware. First off, the way we have the
foundation charter written, the absolute authority in that charter is given to somebody called the
protector. That individual is generally going to be you. So that you have absolute authority
over the foundation. Like I said before, the laws of Panama do not require the identity of the
protector to be in the public record. So you have absolute control, but nobody knows unless you
tell them. Now, having said that, you will have to select two series of successors. One will be
your successor protector. That will generally be an individual. Something happens to you, that
individual will take over control of the foundation completely. The other is the beneficiaries. Now
initially, when you set up the foundation, I recommend that you list yourself as 100%
beneficiary. When we go through the successor issues, you will then decide what you want to do
with your beneficial interest in the foundation. So you might have an individual, you might have
several family members, you might have an organization. You might have several successors.
I want this one to get 20%. I want that one to get 10%. However you want to do it, that will be
a discussion that we will have when you get the foundation documents. So you will decide on
the successorship for both your role as protector, which is effectively God when it comes to the
foundation and your role as beneficiary. So that will be your successorship. Now, when we create
the foundation, we also have simultaneously created an international business corporation.
A private interest foundation is a not-for-profit entity. And what that means is that
the foundation can earn what's called passive income. Like if it owns property and it gets rents,
that's passive income. If it owns stock and it gets dividends, that's passive income. But the
foundation cannot actually run a business. The IBC, the International Business Corporation,
is a corporation. As such, it is a for-profit entity. And it can do things like run businesses,
manage projects, whatever else that involve profit making. Now, like any corporation,
the IBC is controlled by its shareholders. When we set up the IBC for you, the sole shareholder
will be the foundation. Thus, you have absolute control of the foundation. The foundation has
absolute control of the IBC, which means you have control of both entities. But if anybody looks
up the corporation and the public record, they won't find your name. They will find the name of the
foundation. This is to preserve your privacy. I believe that without privacy, you do not have
liberty. Therefore, privacy to me is one of the most important factors. And everything I do is
designed to maximize your privacy and minimize your exposure. So when you have these entities set up
between the two, you can do almost anything. You can buy property, you can hold money
and donate money or give money. You can run a business. You can pretty much do whatever you
want to do anywhere in the world. The only thing I recommend you not do is engage in financial
activities inside the US. If you're going to do these inside the US, there are other entities that
I think are superior. Because if you use your foundation, for example, to set up banking in the
US, you're going to have to get a US EIN. And when you get an EIN in the US, you give control
over that entity to the United States government. So to avoid that, there are other entities that
I would recommend, such as common law, pure trusts, or what we call stealth LLCs, which is a
special kind of stuff, a special kind of LLC. But there are other ways to deal with owning assets
and conducting affairs inside the US. So that's kind of an overview of the situation. Does that help?
That give you good answers? Yes, it does. What do you think about the IBC owning a LLC that then owns
the anonymous domestic stealth LLC? Would you recommend something like that? What I would recommend
in this case is that you set up a consultation where you and I can discuss your specific needs.
Because what will happen is every answer I give you is going to precipitate more questions.
And we have a break we have to go to. So I hope that's helped you. Give us a call off the air.
Give us a call off the air at 888-385-3733, 888-385-Free. And we'll be happy to talk to you about it and set
up time for you to speak with me. Got to go right now. Thanks so much Freeman. God bless you my friend.

Brent Johnson. We will get back to your calls shortly. Robert Anthony Peters is an actor and
filmmaker. After graduating from the University of Arizona in marketing and entrepreneurship,
he was a Charles G. Koch summer fellow in DC and subsequently trained at the Lee Strasburg
Theatre Institute in New York City. Really good outfit. A member of SAG and AFTRA,
he has been acting, producing, directing, and writing professionally in theatre, film,
voiceover, and more for over two decades. His most recognizable film acting roles are in the
pursuit of happiness and Steve Job's. And he will be appearing as Luke in the feature
One Second After. Robert records audiobooks as a policy advisor for the Heartland Institute,
a fellow with both the Archbridge Institute and the Center for American Culture and Ideas.
He is currently reprising the role of Vanek in Vaslav Havel's trilogy of One Acts for
Brickleage Productions. Robert first came across a fully informed jury association pamphlet when
he was in college. It was being distributed at the Libertarian Students' Table. He learned
about jury nullification then and its effectiveness in preserving freedom in our country.
Kirsten Tynan, the former head of Fijia, spoke extensively with Robert about further developing
the organization. She subsequently asked him to join the board. Robert is now chairman of the board
of the fully informed jury association. Robert Anthony Peters, it is my pleasure to welcome you
to the Global Freedom Report. How are you Robert? I'm doing well Brent. Thanks so much.
It's a pleasure to have you and I got to say it for for a long while I thought Fijia had shut
down and I was so thrilled to hear that I was wrong. You know I'm happy to admit when I'm wrong
and especially in a case like this. You know I I'm just delighted to know that you're there.
I'm delighted to know that Fijia is there. Now for many years the fully informed jury association
has worked to teach people about the amazing power of the jury in our free republic.
Juries have the lawful right to not only judge the facts in a case which everybody knows
but most people don't know they may also judge the law itself and if appropriate
void that law would you help us to understand the principle of jury nullification?
Absolutely and again a pleasure to be here. Thank you. Jury nullification is most strictly when
the facts would lead one to a guilty verdict but jurors believe that it would be an inappropriate
verdict for justice to to occur. So it's often the times when you have an issue of an unjust law
or an unjust application of the law or a situation in which a guilty verdict would render a condition
where justice would not occur. So it's also known as a conscientious acquittal. Sometimes a juror's
pardon, a jury veto. So all of these notions where juries feel that a not guilty verdict is the most
appropriate for justice to occur which of course is the whole purpose of the justice system or
should be at least. Excellent. Well can you give us any examples of when jury nullification
was effectively used? So there is a rich history of jury nullification going back to
going back to an earlier period in England from whom America has inherited her justice system.
One of the most critical cases to support the notion of jury nullification or the right I should
say of jury nullification was that of this of a trial of William Penn. William Penn and another
gentleman were on trial for preaching in the streets. They weren't allowed to preach in church.
There was strict laws that only the Anglican religion could be promoted and so they were brought up
on charges of essentially public gatherings. Many of the things that we later saw grievances
posted in the Declaration of Independence, that same notion. They were charged with violating
these ordinances and a jury found them not guilty even though factually one would say that they
had broken the law. And so the judges in that case, there were multiple judges,
it was sort of a panel of judges and they had locked up the jury and said okay they locked
them up in prison or jail for a period and brought them out. The jury still held led by a man named
Edward Bushl. They still held not guilty. The judges put him back in prison in jail and did this a
few times and basically said all right we're going to deprive you of food and water until you
come back with the correct verdict and a higher court intervened and said you can't compel a jury's
verdict. And so that has been a part of our judicial system ever since. The big initial one,
go ahead Brent, sorry. I was just going to say and just for information folks, they had no food,
no water, no toilet facilities and it really was a dungeon. Not like a cell with bars and
everything. It really and truly was a dungeon. No televisions, no gyms, nothing that one might
have the privilege of today. I remember one of the things too was no fire, no smoke, no tobacco.
That was a deprivation that would have been particularly bad back then when it was much more
common. Most most certainly. Yeah, in the in the colonies we get to the 1735.
Let me let me let me let me put a hold on that because we have a break coming up. Hard break. So
stand by keep your thought. Don't forget it. Nestor. Right.

Larry Elder here. You know, I think a lot of people just accept pain like this is just how it is

he got so bad he couldn't even bend it. Now think about that. Trying to work. Take care of your family

Spread it around.
And welcome back. Looks like our guest just dropped off. We're going to hopefully get him.
Is he back? I'm back. I don't know what happened. I don't know what happened there either. But
okay I'm glad you were back. One of the things about a live show is things like that really can
happen. Do you recall what you were about to say before the break? Yeah I was going to talk about
that John Peter Zanger trial which was the first one in the colonies. He was a publisher who had
published about some corruption in the New York state government particularly about corruption
that the governor of that colony had engaged in and was brought up on trial charges of seditious
libel which just at that time it didn't mean libel we commonly think of now as being something
that's untrue. At that time it just meant if you said it was something considered treasonous or
an opposition to the government and it was quite factually clear that he had published these things
and was fine to admit it and the jury found him not guilty. And so that was the first
one of the one of the more important initial uses of jury null education. I could talk about
the history of it but if you've got collars I would be here with you. No no no hang on hang on
I still got questions for you and I have a quick question here. Now hang on. Yeah okay yeah today
I think few people would disagree that the judiciary has become extremely corrupt.
Does the power of jury nullification still exist in today's corrupt judiciary?
That is a great question. It still exists. It's still valid. It's still something that one has a
right to engage in and it's still something that they have not affirmatively stated that
that it can't be used. So in other words it hasn't been shot down. It's something that can still be
used. Now everything stacked against it. Judges for the most part will not inform jurors of this right
and lawyers for the prosecution obviously aren't going to do that. Defense lawyers in general are
barred from bringing that up and jurors will almost without a doubt be dismissed from a case if
potential jurors mention it. So it's an uphill climb. Does it still exist? Absolutely. I mean we
see people being found not guilty even when the facts support it but that a travesty of justice
would occur if that was to happen. What's really sad is we see a number of cases and we get calls
from former jurors who say gosh I wish I knew about this because they felt pressured or compelled
or they felt that they had to just make a decision based on facts alone and then they end up with
tremendous regret because of sentences that have occurred and they recognize that they participated
in injustice and they didn't have a sense of why they could fight against that. And that's why we're
doing a show like this because the idea is to get people educated. We've been trained to find ways
to get out of jury duty. You know come up you know I've got I've got a suggestion tell them this tell
them that. Yes you know and get out of jury duty that's what we've been trained to do what we really
need is to have educated people because it only takes one you know it only takes one person on the
jury who understands this principle who can educate the rest of the jurors and it doesn't matter what
the judge says and it doesn't matter what the prosecutor says and it doesn't matter what the
defender doesn't say. So you know therein lies in my opinion therein lies the solution that that
this is still so very very important and you know Thomas Jefferson actually
you know thought that the power of the jury was so significant okay to maintaining a free society
in our system. Yeah go ahead Robert. You know and it's for people who wonder how can I do something
about what's going on you know I want to be part of a positive change and being on a jury is most
assuredly one of those opportunities. You may end up on the on the case of somebody being
prosecuted for something that should not be a crime or somebody who's getting railroaded by a corrupt
local magistrate and this is your opportunity to truly be a hero to truly save someone's life
and you know getting on the jury to do that as well as being a part of an educator to teach
people about jury and allification. I mean you can create that many more potential heroes out there
so we have all sorts of great materials available that you can get from our website or download and
print up yourself distribute them at courthouse steps bring them to we've got a gun rights pamphlet
that one could to you know if you go to a gun shows or things like that get a booth and talk to
people about it go to your farmers market I mean this is an opportunity for anybody to to learn
about it and then to help educate their community about it so that we can see you know better
outcomes for our fellow man. Absolutely now it's my understanding that in early America
juries were selected randomly and unless a juror had a direct conflict of interest
he or she was not excused from serving when did that change?
That's a great question and I don't know very much I'd have to say about the jury selection
process in terms of history but but we certainly we run into a lot of challenges with that one of
which is the the pereptery challenges where oftentimes lawyers can get rid of so many eligible
jurors and Arizona is an interesting experiment because currently they've gotten away strictly
limited that and so it's not it's a situation in which you know we'll see I mean fortunately we do
have some semblance of federalism and we can see watch different states try different things and
see what what works and what doesn't hopefully. Yep yeah for sure you know that was going to
be my next thing these days attorneys dismiss prospective jurors for almost any reason you know
and that's right yeah it's it's gotten to the point where it seems almost impossible to get a truly
impartial jury. Assuming that and individual's object is to get on the jury what I want all
of you to do if you are called for jury duty consider it an honor and do it okay but if you
get on a jury what do you recommend prospective jurors do if they are being questioned during
a jury impenlement obviously if they say oh yeah I'm very familiar with the fully informed
jury's association they're they're going to be out of there they're not going to get on there.
Yeah the judge will probably dismiss them before even even a lawyer does because they don't want
them talking about jury nullification further. So how do you how do you coach people to actually
get on a jury? Surviving the vaudir process that's that's exactly what you're asking you know it's
one of the ways in which you know I imagine most of your listeners like most people in the world
would seek to be honest you know honorable people and so you know that the sometimes questions will be
asked and will want to to view them from our perspective and volunteer more information and
part of it is viewing it thinking about where you're at and listening to those questions in terms of
the legal environment. So if they ask you could you follow the instructions by the judge?
Well sure I I can imagine a condition under which I could follow the judge's instructions
you know if they're just they comport with the constitution they comport with natural law
you know that right but you're but you're not going to answer it that way you're just going
to say yes. No no no I'm going to say absolutely but you know but some of us are tempted to say
well you know so long as the judge is instructing me things that you know don't violate the
constitution and don't violate natural law and whatever else. Well they're going to toss you
off automatically for that because already you've tipped your hand you're thinking
individual you have reservations you have a mind of your own for the most part they want kind of
plastic people who will just be rather bland and just kind of follow the instructions follow the
guidance of the court and then just make a decision quickly and and easily and so you you you want to
kind of portray yourself as just somebody who's rather amenable maybe somebody who's
be as vanilla as possible that's that's probably my best advice you don't want to stand out.
Remember that the government is not your friend I come from the Thomas Payne School of Government
is necessary evil that means government is fundamentally evil okay you do not play with the devil
so if the object is to get on the jury you tell them you answer the questions in such a way
that they're not going to throw you out it's as simple as that it really is. You got to take
God take another break but when we come back I want to ask you have you served on a jury hold
hold the answer because I've only got a few seconds here okay and we will take your calls
on the other side of the break 866870 KRLA 8668705752 the topic juries and jury nullification

if you listen you can hear the sound of america collapsing we're depression bound
and welcome back to the global freedom report i'm your host Brent Johnson my guest is Robert
Anthony Peters CEO of the fully informed jury association we're talking about juries jurors
and the incredible power that they possess in our society we'll get your calls in just a moment
Robert have you served on a jury i blew it i did exactly the things that i advise people now not
to do and i started talking about jury nullification and i was asked to leave immediately
this was in this was in the early 2000s before i was directly involved i was knowledgeable about
jury i not highly knowledgeable but knew a bit about jury nullification but i but i i was not
involved with fija and didn't know what not to do and so you know i i can only hope that maybe
me talking about it maybe made somebody think something in that process but i doubt i even
got enough out before there was a really interesting situation in tusan, here is on a a few years ago
and it was a grand jury that was summoned and they had they actually mistakenly because they never
would have done this on purpose had a defense attorney on the grand jury and they basically nullified
tons of charges and and it was a big it was a big news item at that at that moment because you
know grand juries are typically famous for uh they say grand jury would would indict a ham sandwich
which of course that was one of those uh funny things about our recent news cycles where there
was the man who threw the sandwich and uh the grand jury didn't indict and so but those those
stories are rare because a grand jury almost always will rubber stamp anything prosecution wants
I I think it's terrific that you stepped in it I think hearing that is terrific because so many
people can relate to that and now look at you look at where you are look at what you are doing
and what you're able to do in influencing people your experience becomes part of your ability to
teach others so my hats off to you for having that happen let's take some calls then we'll get back
to questions Gregory calling in from Los Angeles thank you for waiting Gregory you're on the air
yes good afternoon Gregory I'll do things I'm gonna pull yes I'm here can you hear me okay
yes I can hello yes I hear you very very good I'll phone a little bit your ratic on me none of us
we've got three major issues coming up around first of all with all the border insecurity
over the last previous four years having those how many sleepers as we have running about in
this country best number one time number two we have the 250th anniversary of this country's
founding though I forth and point number three is in this case I'm the direct descendant of the
World War II generation I listened to a lot of radio that I don't hear many callers identify
what generation they are associated with let me show us with you in the end the audience
for future parents they did not they had the common sense not to start a family until they
could be together because they knew there was a good chance that the husband component would
likely be drafted which he was he was building aircraft for the war effort and he had a military
deferment but that ran its course and off he went you know to fight the big ballot at one point
I think he's I was gonna he would be sent to Europe and lo and behold he was sent to the Pacific
theater which I eventually took into the Philippines so that was about a three-year separation between
him and his wife they had no idea if they'd ever see one over again they sacrificed a great deal
of their marriage and whatnot for this country and since then I learned about this history by
asking a lot of questions being as precocious as I was in my earlier years and to me the things
that have gone in this country are just abominable I mean the fact that we have on secure borders for
about four years having a lot of you know how to say undocumented aliens or legal aliens they
would have put it in California where I reside you know we have we have a whole bunch of people
here that have drivers permits not drivers licenses and that was under the George Jerry Brown
administration that he finally signed that that bill into law so to me this is just just some
example of how undermined this country has been brought about by different factions of political
persuasion so this is not what my parents sacrificed their marriage and possibly their time of
heart or even their lives in terms of where they were at the time that they were separated so this
is the thing that needs to be brought across more often by by folk of this generation
yeah absolutely Gregory you raised a brilliant point there because it was World War II that was
used by what we didn't call it the deep state then but they were always in the in the shadows
and World War II was used to diminish the value of the family because you know it used to be the
family had an understanding of what they did in most cases okay the father was a breadwinner the
mother took care of the family cared for the children you know and make sure that you know the
family was functioning well and together they made a team suddenly you take the principal breadwinner
out the women all had to go to work and by the way I'm not speaking out against women going to
work I think it's wonderful okay but the fabric of the family was fairly well destroyed after World
War II and to this day it still has not been resurrected and my hope is that shows like this
are planting those seeds and calls like yours are planting those seeds to get that
resurrected so I know I thank you I thank I thank you for speaking out about it
Oh a new family in action so I'm very grateful to the parents that I had that they understood
what their roles were and they pretty much would discuss that almost three four times a week
in terms of working out the budgets and all this and this is before they had spent you know medical
care and listening that because I was I was the ill child in the family that's a whole different
story excellent but thank you very much for hearing yeah thank you Gregory I appreciate it Eric from
Los Angeles welcome to the show you're on the air with Robert Peters Fijia and tell us what's on
your mind okay I do have a couple questions for your guests before before I ask those questions
may I quickly answer your question your question of the week yes yes absolutely and
just let me let me let me ask it again so anybody who didn't hear it knows what it is the question is
if it was revealed that we really haven't visited by extraterrestrials what immediate effects do you
believe that would have on our world go ahead okay briefly because I don't want to get off to
the topic we're on at the moment it's very good okay if the powers that think they be
uh the shadow government announced to us that we've been visited by or that we have just been
visited by extraterrestrials I would see that as another grand deception there are no little green
men from out there what I do believe I can say it in about two sentences here is that
that these these grades otherwise known as the reticulaeans are genetically engineered bodies
that are indwelled by demons and these bodies are manufactured in these these um earthly
of being beneath the earth factories and installations like area 51 in Nevada dreamland in
socal southern California and that's where all what's going on so that's okay that's my comment
good now Eric I gotta I'm gonna put you on hold Eric I've got a hard break I gotta go to I'm
gonna put you on hold when we come back Robert you're gonna stay with us into the second hour for a bit right
you got it yep all right Eric when we come back we will pick up your call and your question for

and welcome back to our number two of the global freedom report i'm your host Brent
johnson my guest is Robert Anthony Peters of the fully informed jury association if you'd like
to be part of the show the toll free number is 866-870-KRLA that's 86870-5752 we're talking with
eric from los angeles eric thanks for hanging with us welcome back and you said you had some
questions for robert peters so you are back on the air okay i have two questions i have quite a
bit in common with your guest as as a script writer and a trained actor but my questions aren't
about anything in the film industry right now two questions we are well here's question number one
trial by jury that's jeffersonian and it's my understanding that there's a vital difference
between trial by jury and jury trial the trial by jury is what we want
jury trial is something different can you explain clearly what the the lawful differences between
the two are i can't i'm not familiar with a distinction between those two but maybe maybe you
can help tease that out for me yeah i i i would be happy to uh by the way the best book that you
will ever find on this it was written by lyzander spinner i think it was the 18th century maybe the
19th century um called trial by jury and the difference is this trial by jury means the jury
would actually ask questions of the witnesses the trial was conducted by the jury okay a jury
trial is simply a trial in which there is a jury that is sitting there listening to everything
but that jury is supposed to follow the instructions of the judge but a trial by jury is literally
what it says the jury is actually asking questions of the witnesses
wow okay boy does that answer a lot all right my second question last question um it has to do
with okay uh according to constitutional law and procedure we have the right to a trial by jury
for any offense over uh twenty dollars and yet in traffic cases which is one of the main
ways that they have taken our rights away through travel taxes and traffic tyranny
they don't we don't have misdemeanors and felonies anymore except the rare cases they generally call
them and fractions in which they can get away with either bribing the accused to pay it
by mail or in person and not have to tie up the courts um or or otherwise or subject subject you
to their military court how can we get back to um to having the same original rights that our
founders intended for us wow that's a great question that's a very tough question to answer because it
requires a lot of tough actions um you know I I mean obviously they're they're trying to get rid of
jury trials for all sorts of things and they've done a great job of it and the UK is actually
highly on the offensive of that right now you know where where we get trial by jury from
they are uh trying to basically get rid of it but only for some of the highest possible charges
charges that would carry very long prison sentences so um it's it's under threat everywhere um you
know and and where's some of the few places that actually have this the UK and the US and so
you know but as it is for a whole host of crimes uh for which we have the right to trial by jury
we've got um very few of them actually go to trial right so we have plea bargaining that occurs in
uh gosh I think uh it's it's uh in over 97 percent of federal uh trials or federal charges and 95
percent of state I mean I mean we we have so few people who avail themselves of that process and
of course it's a rational decision for many people um you know when prosecutors say hey we're gonna
you know pile on charge after charge after charge so that you can potentially potentially serve
well over a hundred years in prison if you're found guilty or you can take this uh this deal
you do three years uh you know I mean you'll you'll you'll you'll be sentenced to six you'll be out in
three and uh you know we'll call it a day we get a win in our column and we save time and
trouble for the courts um and and what we need to have is people say no I'm not going to take the
deal I am going through with my right to to a trial and for it to be heard by a jury uh but uh that is
a tough a choice it's an expensive choice obviously you know if you are paying for representation
um it's uh it's an incredibly expensive time consuming process uh and there's no uh you know
you don't know what the there's no certainty either so you're taking a risk um so it's it's
asking a lot of people to do the things that are required to remedy that system I think I think
it's possible and I think there and I'm grateful to the people who are willing to go through with that
I also understand why people wouldn't but uh but hopefully we get uh you know more folks who are
willing to do it and we have some interesting you know some great uh lawyers who um who I know
who do pro bono work in some of these fields uh you know some some criminal justice cases that they
they're really willing to help people out with that you have groups like the Institute for Justice
and in in California and in the west you've got um Pacific Legal Foundation uh who uh as well as
I think Alliance Defending Freedom okay yeah Alliance Defending Freedom is another one
there are yeah these these groups that are willing to take on uh a public you know they're
considered public interest law group so they're there to help try to change the law
uh and so they're utilizing cases where they feel confident in their ability to get a good
outcome that this is worth pushing uh and somebody's willing to put up the money um you know so that
the the defendant isn't uh isn't the one who's on the hook for everything uh and let me let me let me
let me also chime in on this eric um what you specifically described traffic and fractions
those are not conducted in judicial courts those are conducted in administrative courts
administrative courts are courts courts that are governed by the executive branch not the
judicial branch so in the judicial branch in matters of law and by the way in the
Constitution when it says law at the time it was written it meant common law doesn't mean
statutory law it didn't exist okay in matters in matters of law over 20 dollars okay that's in
common law in judicial courts the the reason you end up in an administrative court
is because when you got the driver's license you agreed to the terms and conditions of the
issuance of that license and you compromised your fundamental rights when you did that
so it really does get extremely complicated and convoluted and ultimately there there is not a
simple solution because basically you have to go up against the beast you have to be willing
to challenge the beast you know and like i said thomas pain you know said at his best government
is a necessary evil that means government is fundamentally evil you have to be willing to go
up against the evil i'll close it out with some real good news here for you uh then this uh
question on uh about 30 years ago a guy i knew a gentleman i knew he's to see snout was a law
expert not in the thorny but a law expert he caught orange county on violating the rights of
so many accused uh with traffic fines and stuff that he was able to force them to throw out hundreds
of thousands of dollars worth of traffic tickets yes and that is because he went forward and
challenged it and did it good good story good excellent excellent and that and we need more
people who are willing to you know at the end of every show i always say what are you willing to do
to protect and perfect and defend your liberty that's the question every one of you should in the
morning in the evening look in the mirror ask yourself what am i willing to do and what am i
not willing to do to protect and defend my freedom which you got from your god you would think you
would defend it you know and so you know that's what we try and plant that seed in people and i
invite you to ask yourself the question and tell your friends the same thing what are you willing
to do you know and that's that's the question for everybody eric i really appreciate it thank you
so much for the call and god bless you my friend 86687 krla Robert let me ask you this now
does fijia teach people
anything i kind of asked it earlier a little bit okay how to behave when they're put on a jury
now in this case i'm not talking about being in panel you are already on a jury okay and let's say
the jury has been sequester to consider a verdict and let's say the general attitude of the panel
is to convict or to not convict the accused party while your position is the opposite of the
majority how do you suggest that juror act well for a lot of folks it's uh it is a challenge it's
understandable we're social creatures we want to get along with our fellow man but sometimes we have
to recognize that that sometimes we have to disagree with them to do the right thing to serve
a higher purpose and so it's uh it's a challenge but but really having the the strength to know that
you will stick to your principled position if for no other reason then we hear so many sad
stories of people with regret after serving on juries because they went along with the jury
and found someone not found someone guilty because whether they were following the instructions of
the court or they just felt like they had to i mean it's not uncommon for them you know not only
pressure from the jury but pressure from the officials pressure from the judge pressure from
bailiffs other court officials and um i mean there was that uh that case recently of the the
fellow in north carolina who had seen likely um killed his uh numbers his family members and he
was found guilty but now that's been thrown out based off of um what uh a um i think like the
court stenographer had said to the jurors something like oh this shouldn't take long um kind of a
very flippant response but uh you know it's no great thrill to have uh guilty people walk the streets
but uh but we also can't have uh court officials pressuring jurors uh to to render certain verdicts
um but uh yeah it certainly is it's a tough spot to be in but you you know you have to decide do i
want to deal with uh some some hours of discomfort or a lifetime of regret for possibly putting
someone in prison who did not belong there in other words stand your ground Robert hang in with me
we got another break we have to take we'll be right back with more of the global freedom report
so
don't go away there's a lot more of the global freedom report when we come back
doja the department of government accountability this is our citizen led watch dog task force under
american made action we're exposing corruption in child welfare family courts and unconstitutional
federal programs like title four e the funding that is sifted straight down through the help and
hearing services agency into the social security administration and directly out to the agencies
across 50 states that are responsible for the separation of children families and through
lawful notices federal lawsuits and investigated media doja is holding the rogue officials accountable
demanding transparency and restoring parental rights we're not waiting for congress we're the
people taking lawful action now visit american made action dot org hit the take action button
and join the reckoning hi this is sheriff Richard Mack still fighting for american liberty and
you're listening to the global freedom report if you collect a hundred black ants and a hundred
fire ants and put them in a jar nothing will happen but if you take the jar shake it violently
and leave it on the table the ants will start killing each other red believes the black is the
enemy while black believes the red is the enemy when the real enemy is the person who shook the jar
the same is true in society men versus women black versus white faith versus science
young versus old etc before we fight each other we must ask ourselves who shook the jar
i'm mark twain also known as samuel clinton's
please think about your leadership
and welcome back to the global freedom report i'm your host brent johnson my guest is fijia
ceo robert anthony peters welcome back robert if you have a question or a comment you would like to
share or ask the toll free number is 866-870-K-R-L-A that number again 866-870-5752 now
this next question is similar to the last one but a little bit different let us say
you're on a jury and the evidence appears to prove that the accused party is guilty of the crime he
is accused of doing however you believe that the law in question is either unjust or has not been
properly ratified into law how would you suggest that your behave during deliberations
I think that is another great opportunity for for a juror to exercise nullification to engage in
conscious conscience acquittal i mean this this is something throughout the history of the United
States where people have have availed themselves of it when the the fugitive slave law act came
into effect when you had people who were escaping from bondage and traveling to areas in which they
were free and communities in which there were abolitionists they those abolitionists were
legally compelled by the federal government to assist in the capture and return of those slaves
to to their masters and you had a number of juries who would hear factual evidence of
this person engaging in a process of helping this this slave to escape further and the juries
would find them not guilty and it made that that law difficult to enforce
in prohibition you had people who juries who this is one of my favorite stories there was a jury
who had said we'd like to we'd like to examine the evidence and so the veil of brought the the
jug that contained the moonshine into the juror's room and the jury said well you know we've got
to be sure this is what they claim it to be and so they began to sample it one by one and sure enough
they got to the point where all of the evidence had disappeared and so they returned to court and
said your honor there is no evidence of moonshine here so we have no choice but to find the defendant
not guilty so this is it's been an important right throughout history an important opportunity
for people to rectify wrongs that they believe the government has committed and you know there's
the the notion of the four boxes right for for we could say social change or civic advocacy or what
have you there's the soapbox there's the ballot box there's the jury box and there's a cartridge
box and so the jury box is really your last step before the citizenry has to engage in violence
to remedy a problem um i mean i i i am very happy that we have a second amendment and
and that people avail themselves of that uh and don't appreciate any incursions on that
but you you want that to be a last resort and so you want to have exhausted all of your steps before
then your your ability to persuade your your politicians and your fellow man your ability to
to vote for these changes your ability then to decide in the jury box to
do what you can in that that location to bring justice to the fore and so uh it's it's such an
incredibly important right and um and a stopgap both for preventing government oppression and a
kind of a last stop on the way from from social disorder and uh and and political violence from
occurring so we hope that people will avail themselves of this more to create a more peaceful
and just society yeah absolutely true and and by the way you know most people don't even think about
but okay we're supposed to be presumed innocent unless proven guilty yeah but innocent is never
accepted as a plea it's guilty or not guilty yes one of those were the elements of prosecution
propaganda yes it's supposed to be extremely high it's supposed to be beyond a reasonable doubt
and uh this isn't just a i think something happened and and this this notion of a trial by jury it's
so significant in in that it's it was enshrined in the magna carda uh in 1215 in england and and
from there it's been a part of of us history your first caller had brought up the 250th anniversary
the declaration of independence it's mentioned in there it's mentioned both in the constitution
and in the bill of rights both in the constitution and to the amendments thereof trial by jury
is is spoken of i mean it's uh such an incredibly important right that that the trial the right
to a trial by jury is diminishing but also the in particular even even more so the the right to
to vote your conscience on a jury is diminishing even further and and so we need to bring both
both of those rights we need to empower them more but i i think part of part of what would bolster
trial by jury would be if people understood what they can do is jurors and then it's a lot more
than the judge is going to let you believe it's a lot more than probably your civics teacher
told you it's one of the the most effective rights you have to rectify wrongs i mean my gosh you think
when you're voting in an election how often is there an election that only has 12 people voting
very few towns even in america have a condition where you can be as effective as you can be in a jury box
okay one more one more break one more segment couple more questions uh we will be right back
stay with me please we'll be right back with more of trial by jury robert peters and the global freedom
report 866870 krla we'll be right back stay tuned
we'll be back in a moment you're listening to the global freedom report

welcome back right here if you uh want to be part of the show 86870 krla 86870575552 now
robert okay i want to pose for some it would be a philosophical question but uh you know i think i
think it is more of a freedom issue now in a court case okay you and the other jurors may
essentially be determining okay the life or the health or the economic uh well-being or just
playing the freedom of accused parties it's it's a serious issue okay in that
if you if you um decide somebody's guilty who's not guilty they're gonna end up having an unjust
resolution if you decide somebody's not guilty and they are guilty you might let somebody
who's a danger to society free so which is the greater threat to freedom juries that mindlessly
do what they are told to do by prosecutors or juries that nullify laws that are supposed to keep
everybody safer which is the greater threat
uh it's a wonderful question um i i think you know
none of us would like to see very few of us except maybe the most sick would want to see
somebody who has killed someone um killed someone not in self-defense um
or or some other extenuating circumstance uh be free we we don't want murderers rapists
other you know violent criminals to be running a muck most most of us reasonably agree on that
um and so and it is always frustrating and sometimes we look and we say we stupid jurors
how could they do this granted there could be some activist element on occasion uh i think
more than likely what usually happens in circumstances like that is we'd have to know what did the jury
see what was presented to them what did the judge allow or not allow as far as evidence goes as far
as testimony goes um and so you know sometimes there is a miscarriage of justice in that sense
but i do think that the greater crime and the greater threat to civilization and well-being
is when you have people who are innocent or found guilty and imprisoned and you know that uh i
forget who said it uh but uh better that uh a thousand guilty men walk free than one innocent
man be imprisoned um Ben Franklin and Thomas Jefferson both of them
yeah it's uh um it's certainly a notion that i think uh is an important one for um
for for preservation of liberty and and we do we should have the standard for guilt uh to be
exceptionally high because um you know it it should be a a tough obstacle to surmount for us
to strip someone of their liberty and um i again i think most juries most jurors don't want to see
somebody walk free who who they are convinced did something did something maliciously um but you
know an example that that i like there was a a young man who um was uh was being bullied at school
and um he had brought you know he had asked you know politely declined to the uh his assailant
you know but the kid was was insisted on bullying him he brought it up to his teachers he brought
it up to his parents he brought it up to the principals uh he he had exhausted all of his
reasonable processes for um for kind of getting this bullying to stop um finally he warned the
assailant look if you do this one more time i'm going to fight back he wasn't really fighting back
so um the young man um his assailant uh you know struck out at him again and um and he basically
punched the kid uh back the kid hit hit a locker there was something sticking out of that locker
and end up entering his his brain and killed the the other kid the bully died um and he was
being prosecuted for uh and i don't remember what level the crime was it could have been
reasonably had been a manslaughter charged over more reasonably than a manslaughter charge
but they were not viewing this as a self-defense uh thing because you know this the response was
uh unjustified they felt even though it wasn't intended um well the jury uh you know though
factually he was guilty of killing you know this other this other young man um a jury found him
not guilty they they did not believe that these charges uh even if that that justice would have
it would have been a travesty of justice to have convicted this young man who did all he could
to try to reasonably stop this from occurring and for many of us who would say it seems like it was a
a self-defense uh more than anything um so it was a very interesting case but um but you know kind
of another important one you could say well there's another killer walking the streets
well in a fashion for sure but uh but that's the any other outcome would have seemed to have been
an unjust one well and and i think when you cited it you know Ben Franklin and Thomas Jefferson's
comments on it i think that also addresses it that i'd rather see a hundred people
who are guilty go free than one innocent be unjustly incarcerated and i i i you know personally i
think that does very much lay lay the the foundation you know uh that at least for me for me personally
i think the greater threat is to make it easier for someone who did not do wrong to be unjustly
convicted the greater threat is to make that easier than to risk letting a hundred people
who are guilty go free and we think of how much legislation is on the books now how many statutes
exist to the point where as we all know we can knowingly or unknowingly be committing crimes
um and so it just becomes a a world in which if they want to prosecute you for some reason
it's no trouble there's something on the books that they can get you on and so uh you know a
world in which we are all potentially guilty of of violating these rules um we we truly need to
have a renaissance of that perspective where we say you know what should we all be a prison
proven guilty innocent till proven guilty we need to get back to that framework all right
fija.org that's the website fija.org now may people contact you through the website

that we really haven't visited by extraterrestrials what immediate effects do you believe that would
have on our world and now it is time for this week's propaganda 101 propaganda is a manipulation
of the truth to serve a pre-established political or economic agenda Thomas pain wrote that government
is a necessary evil most people read that is meaning government is necessary i read that as
meaning government is fundamentally evil the crisis does your technique is what propaganda
do to always keep the people in a state of agitation and uncertainty which makes them more malleable
and susceptible to manipulation they accomplish this by maintaining a constant state of emergency
throughout the world watch or read the news and you will always see words like blockbuster
breaking critical emergency and the like these words and phrases are designed to keep the general
public in a state of abject terror that the world is about to end people who are in such a state of
mind are very receptive to instructions from so-called authorities this is how and why the
non-existent covid pandemic caused the entire world to shut down with many people ingesting poison
and dying as a result every day there are stories saying that the sky is falling
and the only way to fix it is for the people to do as they are told by propagandists
the general public has been sufficiently stupitified over time so that it is easy to get them to fear
the crisis does your to the point that they will do anything they are told to do
this is how tyrannies are built and maintained and have been so for thousands of years
the only way out of propaganda influences is first to identify the problem
which is that the government is your enemy it seeks to get you to surrender your god-given rights
to personal freedom and individual liberty once you recognize the government is your enemy
and that it seeks to undermine your freedoms it is relatively simple for you to resist propaganda
never forget that government is evil always suspect any information you receive from the
government whether it is direct or indirect make your automatic reaction to anything from the
government be the assumption that whatever government is telling you to do is wrong and evil
so do not do it your default should always be to not comply with the government
once you have adopted this perspective question anything and everything from government
assume it is seeking to harm you and do not go along with whatever it proposes do not cooperate
do not obey and do not comply that is how you defeat propaganda
if you want to learn more about how your rights have been undermined by government propaganda get
a copy of my book the american sovereign how to live free from government regulation check on
my website at www.freedomradio.us everything you find there is designed to help you seek the truth
rather than believe the lies that propaganda uses to influence you that is this week's edition
