BBS Network, Inc. ("BBS," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy describes how we collect, use, disclose, and protect information when you use our website located at bbsradio.com and all related websites, applications, platforms, and services (collectively, the "Services").

This Privacy Policy is incorporated into and made part of our Terms of Use. Capitalized terms not defined in this Privacy Policy have the meanings given to them in our Terms of Use.

  • Submit content through our submission forms (guest applications, music submissions, poetry/lyrics for AI music generation);

  • Create a profile or submit biographical information;

  • Upload audio files, video files, photographs, or other content;

  • Make a purchase or payment through the Services;

  • Subscribe to our newsletters or mailing lists;

  • Contact us with questions, comments, or feedback; or

  • Participate in surveys, contests, or promotions.

  • Content you submit (audio files, video files, music tracks, written works, lyrics, poetry, images);

  • Payment information (processed by third-party payment processors; we do not store complete credit card numbers);

When you access or use the Services, we automatically collect certain information, including:

  • To broadcast, syndicate, and distribute your content to our Syndication Partners;

  • To provide AI music generation services (Make Music);

  • To send you transactional communications (account confirmations, order receipts, technical notices);

  • To analyze usage patterns and trends;

  • To improve, personalize, and expand the Services;

  • To develop new products, services, and features;

  • To conduct research and analytics;

  • To send you newsletters and promotional communications (with your consent where required);

  • To respond to your comments, questions, and requests;

  • To provide customer support;

3.4 Safety and Security

  • To protect the safety and security of the Services and our users;

  • To detect, prevent, and address fraud, abuse, and other harmful activity;

  • To enforce our Terms of Use and other policies;

4. HOW WE SHARE YOUR INFORMATION

4.1 Syndication Partners

We share User Content, along with associated information such as your name, show name, biographical information, and profile photos, with our Syndication Partners for the purpose of broadcasting, distributing, and displaying your content. Our Syndication Partners include over 190 broadcast stations, streaming platforms, podcast networks, and mobile applications. By submitting content through the Services, you consent to this sharing.

4.2 Service Providers

We share information with third-party service providers who perform services on our behalf, such as:

  • Payment processors;

  • Hosting and cloud storage providers;

  • Email service providers;

  • Analytics providers;

  • AI technology providers (for Make Music services);

  • Customer support providers.

These service providers are contractually obligated to use your information only for the purposes of providing services to us and to maintain the confidentiality and security of your information.

4.3 Legal Requirements and Protection

We may disclose your information if required to do so by law or if we believe in good faith that such action is necessary to:

  • Comply with applicable laws, regulations, or legal processes;

  • Respond to lawful requests from public authorities, including law enforcement;

  • Protect and defend our rights or property;

  • Prevent or investigate possible wrongdoing;

  • Protect the personal safety of users or the public.

4.4 Business Transfers

If we are involved in a merger, acquisition, bankruptcy, reorganization, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. 5.2 Sources of Personal Information

We collect personal information from the following sources:

  • Directly from you (registration forms, content submissions, profile information);

  • Automatically from your device (cookies, log files, analytics);

  • Third-party service providers (payment processors, analytics providers).

5.3 Business Purposes for Collection

We collect and use personal information for the business purposes described in Section 3 of this Privacy Policy, including: providing and operating the Services; broadcasting and syndicating content; processing payments; communications; improving the Services; safety and security; and legal compliance.

5.4 Disclosure of Personal Information

In the preceding 12 months, we have disclosed the following categories of personal information for business purposes:

  • Identifiers, Audio/Visual Information, and Professional Information: Disclosed to Syndication Partners for content distribution;

  • Identifiers and Personal Information: Disclosed to payment processors for transaction processing;

  • Internet or Network Activity: Disclosed to analytics providers for service improvement;

  • Written works (lyrics, poetry): Disclosed to AI technology providers for Make Music services.

5.5 Sale or Sharing of Personal Information

We do not "sell" personal information as defined by the CCPA. We do not "share" personal information for cross-context behavioral advertising purposes.

5.6 Your California Privacy Rights

As a California resident, you have the following rights:

Right to Know:

You have the right to request that we disclose: (a) the categories of personal information we have collected about you; (b) the categories of sources from which we collected your personal information; (c) the business or commercial purpose for collecting your personal information; (d) the categories of third parties with whom we shared your personal information; and (e) the specific pieces of personal information we have collected about you.

Right to Delete:

You have the right to request that we delete personal information we have collected from you, subject to certain exceptions. Please note that we may not be able to delete information that has already been syndicated to our Syndication Partners.

Right to Correct:

You have the right to request that we correct inaccurate personal information that we maintain about you.

Right to Opt-Out of Sale/Sharing:

As stated above, we do not sell or share your personal information for cross-context behavioral advertising. If our practices change, we will update this Privacy Policy and provide an opt-out mechanism.

Right to Limit Use of Sensitive Personal Information:

We do not use or disclose sensitive personal information for purposes beyond those permitted by the CCPA without your consent.

Right to Non-Discrimination:

We will not discriminate against you for exercising any of your CCPA rights.

We will verify your identity before processing your request. You may designate an authorized agent to make a request on your behalf by providing written authorization.

5.8 Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Content that has been syndicated or archived may be retained indefinitely by our Syndication Partners in accordance with the licenses granted in our Terms of Use.

6. TEXAS PRIVACY INFORMATION

If you are a Texas resident, you may have certain rights under Texas law regarding your personal information.

6.1 Data Security

In accordance with the Texas Business and Commerce Code, we implement and maintain reasonable procedures to protect sensitive personal information from unauthorized access, use, or disclosure.

6.2 Data Breach Notification

In the event of a breach of system security involving your sensitive personal information, we will provide notice as required by Texas law. If the breach affects 250 or more Texas residents, we will also notify the Texas Attorney General.

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not provide any information to us or use the Services.

If we learn that we have collected personal information from a child under 13, we will take steps to delete that information as quickly as possible. The Services require users to be at least 18 years of age. We do not knowingly allow individuals under 18 to create accounts or submit content.

10. THIRD-PARTY LINKS AND SERVICES

The Services may contain links to third-party websites, applications, or services that are not owned or controlled by BBS. This Privacy Policy applies only to the Services. We are not responsible for the privacy practices of third-party websites or services. We encourage you to review the privacy policies of any third-party websites or services that you visit.

When you use our AI music generation service (Make Music), your submitted content may be processed by third-party AI technology providers. The processing of your content by these providers is subject to their own privacy policies and terms of service.

11. INTERNATIONAL USERS

The Services are operated from the United States. If you are accessing the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located.

By using the Services, you consent to the transfer of your information to the United States and the collection, storage, and processing of your information in the United States in accordance with this Privacy Policy. Please be aware that data protection laws in the United States may differ from those in your country of residence.
